These Terms of Service (“Terms”) govern your use of the web design, marketing, domain assistance, hosting setup, file upload assistance, and related services provided by QDOMU (“Company,” “we,” “us,” or “our”). By purchasing, using, or requesting services from QDOMU, you (“Client,” “you,” or “your”) agree to be bound by these Terms.
QDOMU offers website design and marketing services, including website setup, development assistance, domain name assistance, hosting setup assistance, file upload assistance, and related digital services.
The exact services to be provided may be described in a written proposal, invoice, statement of work, email, or other agreement between QDOMU and the Client.
QDOMU may assist Clients with searching for, registering, configuring, or connecting a domain name.
Unless otherwise stated in writing, QDOMU’s role in domain-related services is limited to assistance and setup. The Client is responsible for ensuring that the selected domain name does not infringe on any trademark, copyright, business name, brand name, or other third-party rights.
QDOMU does not guarantee the availability, ownership, renewal, transferability, legality, or continued use of any domain name.
QDOMU may assist with setting up, configuring, or connecting the Client’s website to a hosting service.
The Client understands that website hosting may be provided by QDOMU, a third-party hosting provider, or another service selected by the Client. QDOMU is not responsible for outages, service interruptions, data loss, security breaches, server failures, provider errors, or any other issue caused by a third-party hosting company or service provider.
QDOMU may assist with uploading website files, images, documents, databases, themes, plugins, scripts, or other materials to the Client’s hosting account.
QDOMU is not liable for any loss, corruption, deletion, damage, or failure to restore files, databases, website content, emails, media, backups, or other data.
The Client agrees that it is the Client’s responsibility to keep independent backups of all website files and data before QDOMU performs any setup, migration, upload, configuration, update, edit, or hosting-related work.
The Client is responsible for providing all content, images, logos, text, videos, documents, files, login credentials, account access, business information, and other materials needed to complete the project.
Once a website, page, file, design, upload, setup, or configuration is reviewed, approved, published, or accepted by the Client, the Client assumes full responsibility for the website and its content.
Website hosting services renew every 30 days unless otherwise stated in writing.
The Client is responsible for paying all hosting fees on time.
If the Client misses a hosting payment, QDOMU may allow a grace period of up to 30 additional days for the Client to make payment and keep the website live.
QDOMU reserves the right to suspend, disable, restrict access to, or shut down the Client’s website, hosting service, domain connection, website files, administrative access, or related services for non-payment.
If payment is not received within the allowed payment period or grace period, QDOMU may take the website offline without further notice.
All fees, deposits, recurring payments, setup charges, design fees, development fees, hosting fees, domain fees, maintenance fees, and other charges are due as stated on the applicable invoice or agreement.
QDOMU may use or assist with third-party services including domain registrars, hosting companies, website builders, plugins, themes, payment processors, analytics tools, and security services.
QDOMU is not responsible for the acts, errors, policies, failures, pricing changes, downtime, data loss, service interruptions, account suspensions, or security issues of any third-party provider.
Unless a maintenance plan is purchased or agreed upon in writing, QDOMU is not responsible for maintaining, updating, monitoring, repairing, backing up, securing, or modifying the Client’s website after launch.
QDOMU does not guarantee that any website, hosting account, domain account, file, plugin, theme, form, script, or server will be secure, uninterrupted, or free from unauthorized access.
To the maximum extent permitted by law, QDOMU shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, lost business, lost customers, lost data, lost files, service interruption, website downtime, reputational damage, or loss of goodwill.
The Client agrees to defend, indemnify, and hold harmless QDOMU, its owners, employees, contractors, agents, partners, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses arising out of or related to:
Unless otherwise agreed in writing, QDOMU retains ownership of any pre-existing tools, templates, code, designs, systems, processes, frameworks, concepts, or materials used to create the Client’s website or marketing materials.
The Client may be required to provide QDOMU with login credentials or access to hosting accounts, domain accounts, website platforms, email accounts, payment systems, or other services.
QDOMU is not responsible for delays caused by the Client’s failure to provide content, feedback, approvals, access, payment, or required information.
QDOMU does not guarantee that a website or marketing campaign will achieve any specific results including sales, leads, traffic, search engine rankings, conversions, revenue, business growth, or customer engagement.
QDOMU may terminate or suspend services if the Client violates these Terms, fails to pay amounts owed, misuses services, or provides unlawful content.
QDOMU may update these Terms from time to time. Continued use of QDOMU’s services after changes are posted means the Client accepts the updated Terms.
These Terms shall be governed by the laws of the State of Missouri, United States, without regard to conflict of law principles.
